Emponix.com acts as a portal to provide you with information related to our service provider or partner merchants or links to external websites. It would be sole discretion to choose the service provider or partner merchants for your purchase. If you make a booking or enter into a transaction with the service provider, ensure you have the legal authority to enter into such an agreement. In addition, you agree that you will be financially responsible for all charges(including duties, fees and taxes) incurred in the course of your purchases.

You must take the time to read any Terms and Conditions published by the service provider or partner merchant as you will be bound by them.

emponix.com cannot accept liability for the services provided by any of the service providers or partner merchants featured on this site. We neither endorse nor take responsibility for the performance or level of enjoyment of any product or service listed on this site.

Accuracy
We at Emponix.com have done our best to ensure that the information on this Web site is accurate; however, we cannot guarantee that all the information, especially that supplied by third parties (such as Retail Agents other service providers or partner merchants), is correct or complete. Pages on the site are provided to users ‘as is’ and ‘as available’, and may have technical inaccuracies. We will endeavour to update and correct this site as soon as new information becomes available to us, but we cannot make any guarantee on when these updates will be made. We cannot be responsible for any damage or loss that may arise, directly or indirectly, from the use of information contained on this Web site.

Membership
We are pleased that you are signing up to take advantage of all that Emponix has to offer. As with any online service, we must establish some basic rules regarding the use of our site and participation in our program.

The profitus Member Agreement sets forth the terms and conditions of your profitus membership. As a condition of membership, you must accept the agreement in its entirety; therefore, we encourage you to carefully review and familiarise yourself with it. In addition, you should review the agreement from time to time for any important changes. Profitus membership will be available at a cost decided by the company as on date. The current version of the profitus Member Agreement will always be available on the Emponix web site.

Members cannot have multiple accounts. Any members found to have additional memberships will have their account suspended and membership fee will not be refunded.

PROFITUS MEMBER AGREEMENT
Terms of service Emponix ("Emponix") and all of its services (the "Service") are governed under this member agreement (the "Agreement").

You must get profitus membership card to participate in this Service. In order to become member you need to submit the duly filled application form along with the membership fee and also need to read and agree to the terms and conditions of the Agreement. However, the grant of membership is not automatic but is at the discretion of Emponix. Any person who becomes profitus member and agrees to abide by the terms of the Agreement is referred to herein as a "Member". By using the services and links provided on this site, it is therefore determined that you have accepted the terms and conditions contained.

Emponix reserves the right, at any time, to:

(i) Change the terms of this Agreement,
(ii) Change or discontinue the Service, whether temporarily or permanently, including any content or feature of the Service, restricting the hours of availability or limiting the amount of use permitted by the Member, or
(iii) Change any fees or charges for use of the Service, including instituting new fees or charges for the use of the Service or any feature thereof.

Only a person of 18 years and above can become a member.

Emponix reserves its right to change the membership fee at any time, though this shall not affect the existing members, the renewal of the membership will be subject to payment of membership fee at current rates.

Notice of any changes to this Agreement will be posted on the Site. All changes shall be effective immediately upon notice. Emponix is not responsible if you do not receive notice of such changes to the Service. Any use of the Service under a Member’s Account after such notice shall be deemed to constitute acceptance by the Member of the changes.

Emponix reserves the right to terminate any accounts, and pay back any membership/subscription fee based on a pro-rata basis of the annual membership time frame at our own discretion and correspondence will not be entered into.

Emponix reserves the right to terminate any account containing untruthful information and to prosecute individuals who deliberately provide false information in order to take advantage of any of the services and in such event membership fee will not be refunded.

Upon submission of a completed application and acceptance of the terms of the Agreement, you will be sent a personalized membership card to activate your account. Your card is personal to you; you may not allow anyone else to use your card and you may not use anyone else’s card. You are responsible for keeping your card safe. In event of a member losing or misplacing his/her Membership card, the same should be reported to Emponix as soon as possible. Duplicate Membership card on such terms and conditions as company may require will be issued, upon a charge of fee for issue.

You agree to let Emponix know of any unauthorised use of your card or any other suspected breach of security.

All members are responsible for complying with local regulations and Emponix assumes no liability in this respect.

Emponix reserves the right to limit program enrollment at any time.

Emponix reserves the right to transfer the membership agreement to a subsidiary of Emponix. In this case members would be served by such subsidiary.

Emponix reserves the right to terminate membership without any further obligation to the Member in cases of abuse of Service rules and to take legal action in all such cases, including falsifying information, or if Member appears to be using the service in a manner inconsistent with this Agreement or the intent of the Service or any portion thereof, or who acts in a manner inconsistent with applicable laws, statutes or ordinances or if you use, or attempt to use, any part of the Service or the presentations for other purposes including, but not limited to, tampering, hacking, spoofing, using robots or scripts, copying, distributing, modifying, or otherwise corrupting the administration, security, or proper function of any part of the Service.

Members may terminate their membership at any time; however any annual subscription is non-refundable.

Any membership lasts no longer than 12 months. Upon expiry of membership it is at the members’ discretion to renew or not. The member may re-activate their membership and carry on their membership at the prevailing subscription fee at that time.

Emponix shall not be responsible for failure or delay in delivering its obligations due to circumstances beyond its reasonable control, including, without limitation to, acts of any governmental body, war, insurrection, sabotage, terrorism, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation and failure of third party or inability to obtain supplies.

Incentives
It is the case that from time to time that new member incentives or promotions will be introduced. These may include membership fee discount to the account opening of a new member. These incentives and promotions can be used in advertising campaigns linked to either certain publications or merchants that feature within the site. It is accepted that these incentives or promotions cannot be backdated to incorporate your membership.

DISCLAIMER OF WARRANTIES

Members expressly agree that use of the Service is at the member’s sole risk. The Service is provided on a strictly "as is" and "available" basis.

Emponix MAKES NO WARRANTY WITH REGARD TO ANY PRODUCTS, SERVICES OR REWARDS OBTAINED BY MEMBERS THROUGH THE SERVICE OR THROUGH SERVICE ADVERTISERS OR PARTNERS; THAT THE SERVICE WILL MEET MEMBER’S REQUIREMENTS; OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, ERROR FREE; NOR DOES EMPONIX MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE.

You understand and agree that any material and/or data downloaded or otherwise obtained through or from the Service is at your own discretion and risk, and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data.

The Service shall not be liable or responsible for those guarantees, warranties and representations, if any, offered by Service advertisers, partners, vendors, manufacturers of merchandise or suppliers of services. No advice or information, whether written or oral, obtained by Members from Emponix or through the Service shall create any warranty not expressly made herein.

Notwithstanding these precautions, however, there are certain conditions that exist on the Internet generally which are outside Emponix control and could result in a breach of security.

Accordingly, Emponix cannot guarantee that your confidential information will be free from corruption or piracy. You hereby expressly waive any claim against Emponix arising out of the loss of data through corruption, piracy, breach of security or for any other reason.

Participation in promotions of advertisers, partners and vendors. Member’s correspondence with or participation in promotions of the Service advertisers, partners and vendors are solely between corresponding Members and the service provider, partner merchant.

Emponix assumes no liability, obligation or responsibility for any part of any such correspondence or promotion. If you do release your personal information to a third party, Emponix will not be responsible for any adverse consequences that may result there from.

Decisions to make any purchases through any partner merchant featured within this site should not be based upon the value of the discount offered. Once you have entered into a contract with a retailer by making a purchase you will be bound by their own terms and conditions and you should make yourself aware of these before hand.

INDEMNIFICATION

Message Forum
If a message forum is introduced to the Emponix site you take full responsibility for the content you post. If you post defamatory or other illegal content you will be held personally responsible for publishing such material. Emponix does not want its users caught up in costly legal actions so please ensure you abide by these guidelines! The company disclaims all responsibility for publishing content in the Message Forum. Defamatory or other unlawful content will be removed from the site by an authorised moderator.
